Affordable Care Act Penalties
The IRS assessed approximately $200,000 in ACA civil penalties against our client for failing to file and furnish Form 1095-C/1094-C. IRS assessed $100,000 for failing to file the forms and $99,000 for failing to furnish. The client was completely unaware of ACA requirements. A third-party payroll service was used but it did not advise of the need to file and furnish Form 1095-C/1094-C.
Penalty Abatement Approval
We helped the client appeal the assessments. It was a long a complicated appeals process due to the way that the IRS assesses penalties under Section 6722 of the Internal Revenue Code. Ultimately, we had to file a formal written protest arguing reasonable cause and significant mitigating factors. The IRS Office of Appeals took up the case and reduced the penalties to $5,720 for failing to file and $5,460 for failing to furnish.
